This review article aims to identify the legal challenges in the coming decades with regard to digital inclusion and the formation of a virtual public space. Thus, in this review article, inequality will be analyzed with regard to access to new communication technologies and the internet, and digital division is subdivided into: global division, social division and democratic division . In addition, the key problem is related to the feasibility of guaranteeing democracy in an unequal environment with regard to access to information available on the internet. Our bibliographic research uses the analytical method to analyze the data obtained and the arguments presented in the research. In addition, when studying the issue concerning hate speech and the invasion of privacy, it is important to highlight the use of the monographic method. Firstly, the question regarding the existing imbalance between countries in terms of internet penetration and access to information will be studied, noting that the gap between poor and rich countries can be widened if this difference intensifies. Secondly, the issue of social division will be analyzed, which concerns the imbalance in access to information and the internet within each country. The strengthening of education becomes a fundamental instrument for Brazil to overcome the social divide, since it is not enough to provide access to the internet, it is necessary to prepare citizens to benefit from the infinite information available. Democratic division becomes an extremely important challenge to constitutional justice, due to the relevance of establishing parameters for balancing freedom of expression and the invasion of privacy / hate speech. The virtual public space will only become effective when there is no digital divide, so it is necessary to strengthen and create legal instruments that guarantee democracy in an Information Age. Therefore, it was found that, in Brazil, the digital divide is a reality and affects the construction of a democratic space in the digital environment in which the discourse corresponds to citizens addressing other citizens on an equal footing.
O objetivo central é identificar os desafios do direito nas próximas décadas no que concerne à inclusão digital e à formação de um espaço público virtual. Dessa forma, neste artigo de revisão, será analisada a desigualdade no que se refere ao acesso à novas tecnologias de comunicação e à internet, sendo que denominaremos esta segregação de divisão digital, a qual é subdividida em: divisão global, divisão social e divisão democrática. Assim, o problema-chave é relativo à viabilidade de se garantir a democracia em um ambiente desigual no que se refere ao acessso à informação dismonível na internet. Trata-se de uma pesquisa bibliográfica, empregando-se o método analítico para analisar os dados auferidos e os argumentos doutrinários apresentados na pesquisa. Além disso, ao se estudar a questão concernente aos discursos de ódio e à invasão da privacidade, cumpre-se destacar o emprego do método monográfico. Em um primeiro instante, será verificada a questão relativa ao desequilíbrio existente entre os países no que tange à penetração da internet e ao acesso à informação, notando-se que o abismo entre países pobres e ricos pode ser ampliado se esta diferença intensificar-se. Em segundo lugar, analisar-se-á a problemática relativa à divisão social, que diz respeito ao desequilíbrio quanto ao acesso à informação e à internet no âmbito de cada país. O fortalecimento da educação torna-se instrumento fundamental para que o Brasil supere a divisão social, visto que não basta fornecer acesso à internet, é necessário o preparo dos cidadãos para se beneficiarem das infinitas informações existentes. A divisão democrática torna-se um desafio importantíssimo à justiça constitucional, em razão da relevância de se estabelecer parâmetros para a ponderação entre a liberdade de expressão e a invasão de privacidade/discursos de ódio. O espaço público virtual apenas efetivar-se-á quando não existir a divisão digital, logo, é preciso fortalecer e criar instrumentos jurídicos garantidores da democracia em uma Era da Informação.Por conseguinte, constatou-se que, no Brasil, a divisão digital é uma realidade e afeta a construção de um espaço democrático no ambiente digital em que o discurso seja de cidadãos dirigindo-se a outros cidadãos em situação de igualdade.
