Resumen de O objetivismo moral e o interpretativo na teoria de Ronald Dworkin

  Through a bibliographical research with a qualitative approach, the research proposes to analyze, from the perspective of Ronald Dworkin’s theory, the judicial interpretation about the moral values and the refutation of judicial discretion, to avoid arbitrariness, voluntarism and subjectivism that are contrary to a policy guaranteeing fundamental rights. Instead to the ideas defended by the positivist paradigm, hegemonic model in modernity, which defends the discretion of the judicial power, Dworkin’s interpretivism defends the connection between law and moral, and the objective interpretation even in alongside values.

  Por intermédio de pesquisa bibliográfica de abordagem qualitativa, a pesquisa propõe-se a analisar, sob a perspectiva da teoria do autor norte-americano Ronald Dworkin, a interpretação judicial à luz de valores morais e do afastamento da atuação discricionária dos juízes, de modo a evitar as arbitrariedades, voluntarismos e subjetivismos decisórios que são contrários a uma política garantidora de direitos fundamentais. Ao contrário das ideias defendidas pelo paradigma positivista, modelo hegemônico na modernidade jurídica, que acenam à discricionariedade do intérprete judicial, o interpretativismo de Dworkin defende a conexão entre direito e moral e a objetividade interpretativa mesmo diante dos valores.
