El presente trabajo tiene como objetivo analizar, en el contexto de la globalización, el impacto que la delincuencia organizada transnacional ejerce sobre los derechos humanos. Este fenómeno, de naturaleza eminentemente económica y material, ha motivado la reacción de los Estados, quienes buscan su erradicación o minimización mediante la aplicación de políticas de control social y derecho penal del riesgo, así como del denominado derecho penal del enemigo o de tercera velocidad. Estas estrategias, sin embargo, deben estar limitadas por la concepción, naturaleza, sentido y alcance de los derechos humanos, así como por la fuerza normativa constitucional de cada Estado. La demanda social de seguridad ciudadana ha impulsado la implementación de políticas criminales de control social estricto, contexto en el cual no debe permitirse la vulneración de la dignidad humana. Se realiza un análisis documental bajo el paradigma cualitativo, con una interpretación reflexiva sobre la episteme de los derechos humanos, la globalización y la delincuencia organizada transnacional, cuyo crecimiento amenaza la estabilidad política, social, económica y cultural de los Estados. El capital social de estas organizaciones facilita su resiliencia y expansión.
The purpose of this paper is to analyze, in the context of globalization, the impact of transnational organized crime on human rights. This phenomenon, of an eminently economic and material nature, has motivated the reaction of States, which seek to eradicate or minimize it through the application of policies of social control and criminal law of risk, as well as the so-called criminal law of the enemy or third speed. These strategies, however, must be limited by the conception, nature, meaning and scope of human rights, as well as by the constitutional normative force of each State. The social demand for citizen security has driven the implementation of criminal policies of strict social control, a context in which the violation of human dignity should not be allowed. A documentary analysis is carried out under the qualitative paradigm, with a reflexive interpretation on the episteme of human rights, globalization and transnational organized crime, whose growth threatens the political, social, economic and cultural stability of the States. The social capital of these organizations facilitates their resilience and expansion.
