El régimen jurídico de las viviendas de uso turístico está siendo objeto de un gran impacto por parte de la actividad administrativa de limitación en los últimos años. La explicación de este fenómeno tiene lugar como consecuencia del gran incremento de este tipo de actividad económica y sus principales efectos: en primer lugar, el impacto negativo sobre el mercado del alquiler residencial; y, en segundo lugar, la saturación turística generadora de una erosión urbana cada vez más destacada. Estas razones, entre otras, han generado una fuerte reacción de los distintos sujetos competentes en materia de turismo (pero también otras materias conexas), que ha desembocado en la aplicación de técnicas de intervención administrativa de una forma poco respetuosa con la naturaleza jurídica de estas. Si bien la técnica preeminente amoldada sigue siendo la declaración responsable, la apresurada respuesta normativa frente al fenómeno de las viviendas de uso turístico ha esculpido dicha institución hasta el punto de provocar el desconocimiento de sus características básicas, hecho que inevitablemente conlleva la inmersión de los operadores económicos en una densa inseguridad jurídica.
The legal regime of housing for tourist use has been subject to a great impact of the administrative activity of limitation in recent years. The explanation of this phenomenon takes place as a consequence of the great increase of this type of economic activity and its main effects: firstly, the negative impact on the residential rental market; and, secondly, the tourist saturation generating an increasingly prominent urban erosion. These reasons, among others, have generated a strong reaction from the various authorities responsible for tourism (but also for other related matters), which has led to the application of administrative intervention techniques in a manner that is not very respectful of their legal nature. Although the pre-eminent technique is still the responsible declaration, the hasty regulatory response to the phenomenon of tourist dwellings has sculpted this institution to the point of causing ignorance of its basic characteristics, a fact that inevitably leads to the immersion of economic operators in a dense legal uncertainty.
