La regulación del reconocimiento en rueda de personas en la Ley de Enjuiciamiento Criminal española plantea cuestiones e inconvenientes que podrían derivar en la condena errónea de un inocente y la vulneración de la tutela judicial efectiva y del derecho a la presunción de inocencia. Dicha regulación podría, sin lugar a duda, enriquecerse mediante las pautas ofertadas por la psicología jurídica y la psicología del testimonio, lo que en último lugar reduciría los errores judiciales. El presente trabajo se constituye como un análisis de la legislación mencionada a la luz de dicha rama del conocimiento, así como de otros ordenamientos jurídicos para proponer soluciones a las actuales carencias del sistema judicial español.
The regulation of the identification parades in the Spanish Criminal Procedure Act raises issues and drawbacks that could lead to the wrongful conviction of an innocent person and to the violation of the right to effective legal protection and the right to be presumed innocent. This regulation could be undoubtedly enriched by the guidelines that the legal psychology and the psychology of testimony offer, which would ultimately result in a reduction of miscarriages of justice. This project is an analysis of the aforementioned legislation and other legal systems in the light of this branch of knowledge. Its aim is to propose solutions to the current shortcomings of the Spanish judicial system.
