Este artículo profundiza en la naturaleza y la interdependencia del derecho colectivo del trabajo (libertad sindical, negociación colectiva y derecho de huelga) con otros derechos humanos fundamentales. A través de un análisis dogmático y jurisprudencial, se explora cómo las personas trabajadoras en su dimensión individual y colectiva requieren de la libertad de expresión, libertad de asociación e igualdad y no discriminación, para transitar en el mundo de trabajo decente, en una justicia social y su contribución a sociedades justas. Se examina el papel de las diversas legislaciones a nivel internacional, en su consagración y protección, sin soslayar sus limitaciones inherentes y la imperiosa necesidad de armonizar su ejercicio con otros derechos fundamentales.
This article delves into the nature and interdependence of collective labour law (freedom of association, collective bargaining and the right to strike) with other fundamental human rights. Through a dogmatic and jurisprudential analysis, it explores how workers in their individual and collective dimension require freedom of expression, freedom of association and equality and non-discrimination, to move in the world of decent work, in social justice and their contribution to just societies. The role of the various legislations at the international level in their consecration and protection is examined, without ignoring their inherent limitations and the imperative need to harmonize their exercise with other fundamental rights.
