Based on a literature review methodology, this paper aims to understand how the Systems Theory, developed by Niklas Luhmann, deals with conflict in modern society. For this purpose, an analysis of conflict will initially be carried out based on the Luhmannian triad: complexity, selectivity and contingency. After that, the question of whether the systems theory fits into the sociological tradition as a consensus or a conflict theory will be examined. Finally, we move on to an analysis of conflict in the legal system, topped up by a brief digression on the role of modern constitutions in the face of social conflicts. In conclusion, it is understood that the systems theory implicitly questions the very unity of the difference between consensus and conflict, starting from the triad mentioned above to signal an alternative way of thinking that embraces social conflict.
O presente artigo pretende compreender como a Teoria dos Sistemas, desenvolvida por Niklas Luhmann, trata o conflito, na sociedade moderna, a partir da metodologia de revisão bibliográfica. Para isso, inicialmente, realizar-se-á a análise do conflito considerando a tríade luhmanniana: complexidade, seletividade e contingência. Em seguida, será esmiuçada a questão acerca do encaixe da teoria dos sistemas como teoria do consenso ou teoria do conflito na tradição sociológica e, então, parte-se para uma análise do conflito no sistema jurídico, complementada por uma breve digressão sobre o papel das Constituições modernas diante dos conflitos sociais. A título conclusivo, entende-se que a teoria dos sistemas questiona implicitamente a própria unidade da diferença entre consenso e conflito, partindo da tríade referida, para indicar um pensamento alternativo que envolve a conflituosidade social.
