The state of pandemic emergency requires the interpreter to identify coordinates for a proper balance between individual rights and the rights of the community as a whole. These are tragic choices that question the political legislator and find their reference in Article 32 of the Italian Constitution, which “protects health as a fundamental right of the individual” and, at the same time, as a “general interest of the community.” The new post-pandemic normality will be shaped around the dialectic between two ways of conceiving emergency. On one hand, the democratic-social paradigm, starting from the postulate of the ontological vulnerability of the person, aims to prevent emergencies. On the other hand, the neoliberal paradigm, starting from the postulate of the necessary resilience of the person, ends up normalizing the logic of emergency and shifting onto the individual the responsibility for their own vulnerability.
O estado de emergência pandêmica exige do intérprete a identificação de coordenadas para um equilíbrio adequado entre os direitos do indivíduo e os direitos da coletividade como um todo. São escolhas trágicas que questionam, antes de tudo, o legislador político e encontram sua referência no artigo 32 da Constituição italiana, que "protege a saúde como um direito fundamental do indivíduo" e, ao mesmo tempo, como um "interesse geral da coletividade". A nova normalidade pós-pandêmica se delineará em torno da dialética entre duas maneiras de conceber a emergência. De um lado, o paradigma democrático-social que, partindo do postulado da vulnerabilidade ontológica da pessoa, busca prevenir emergências. Por outro lado, o paradigma neoliberal que, partindo do postulado da necessária resiliência da pessoa, acaba por normalizar a lógica da emergência e descarregar sobre o indivíduo a responsabilidade de sua própria vulnerabilidade.
