¿Está realmente el Tribunal de Estrasburgo en la “era de la subsidiariedad” tras la entrada en vigor del Protocolo núm.15?

    Este trabajo tiene como objeto el análisis del Caso Verein Klimaseniorinnen Schweiz y Otros contra Suiza, de 9 de abril de 2024. Se trata del primer asunto en el que el Tribunal Europeo de Derechos Humanos condena a un Estado por no proteger suficientemente a sus ciudadanos frente al cambio climático. En esta sentencia, el Tribunal de Estrasburgo reconoce un 'derecho a la protección efectiva frente a los efectos adversos graves y los riesgos en la vida, bienestar y calidad de vida causados por el cambio climático'. Sin obviar la importante amenaza que el cambio climático supone a nivel mundial, la inclusión, dentro del ámbito de aplicación del artículo 8, de este nuevo derecho no previsto en el Convenio, choca de lleno con la reciente reforma del preámbulo producida por el Protocolo núm. 15. Reforma que, al introducir de forma expresa el principio de subsidiariedad y el margen de apreciación nacional, refleja el deseo de los Estados parte de una mayor deferencia en su papel de protección de los derechos y supone una llamada al Tribunal al ejercicio de self restraint.

    This paper explores the case Verein Klimaseniorinnen Schweiz and Others v. Switzerland, decided on April 9, 2024. This is the first case in which the European Court of Human Rights has condemned a State for failing to sufficiently protect its citizens from climate change. In this decisIon, the Strasbourg Court recognizes a "right to effective protection against serious adverse effects and risks to life, well-being, and quality of life caused by climate change." Without ignoring the significant global threat caused by climate change, the inclusion of this new right—unforeseen in the Convention—within the scope of Article 8 conflicts directly with the recent preamble reform introduced by Protocol No. 15. his reform, by expressly introducing the principle of subsidiarity and the margin of national appreciation, reflects the desire of States Parties for greater deference in their role of protecting rights and calls on the Court to exercise self restraint.
