Taking into consideration Enrico Gabrielli’s work, the essay at stake deals with some relevant issues linking parties’ contractual autonomy and the firm, having particular regard to the freedom to set up and run the economic activity as recognized by Italian Constitution, as well as to some up-to-dated trends in the field of consumers’ protection and sustainability at European level. Final remarks are dedicated to Supervisory Authorities’ interventions on contractual autonomy of the parties (namely, with reference to bank’s jus variandi) and, furthermore, to identify the controversial qualification of asset managers’ activity as enterprise and, subsequently, to the application of Antitrust Law.
