La Sentencia del TJUE de 24 de febrero de 2022 concluye que la normativa interna que prohibió que las empleadas de hogar accedan y coticen por desempleo es una discriminación indirecta por razón de sexo. La aplicación directa de dicha doctrina del TJUE por los Tribunales desplaza tal regulación y la corrige de forma que los períodos de alta durante los que las empleadas de hogar no pudieron cotizar por impedirlo una norma discriminatoria sirven para reconocer el derecho al subsidio por desempleo tanto contributivo como asistencial.
The CJEU ruling of February 24, 2022, concludes that the domestic rules that prevented domestic workers from accessing and contributing to unemployment benefits constitute indirect discrimination based on sex. The direct application of this EU doctrine by the Courts displaces this internal rule and corrects it so that it is understood that the periods of enrolment during which domestic workers were unable to contribute because a rule declared discriminatory prevented them from doing so serve to grant the right to contributory and assistance unemployment benefits.
