El artículo versa sobre una resolución judicial en la que se debate sobre la existencia de una decisión empresarial de extinción de contratos sin cumplir la tramitación requerida para llevar a cabo un despido colectivo. Dado que queda probado que no se han producido las extinciones contractuales, existe falta de acción e inadecuación de procedimiento que condiciona la competencia objetiva del tribunal. Queda sin juzgar, por no ser objeto del litigio, la posible subrogación de una de las codemandadas.
The article deals with a court decision in which the existence of a company decision to terminate contracts without complying with the procedures required to carry out a collective dismissal is debated. Given that it is proven that the contractual terminations have not taken place, there is a lack of action and procedural inadequacy that conditions the objective competence of the court. The possible subrogation of one of the co-defendants remains unjudged, as it is not the subject matter of the litigation.
