El presente trabajo aborda la figura de la paelex en su contexto jurídico y ritual durante el período de la monarquía romana. Este último elemento de temporalidad nos obligará a enfrentar la crítica histórica, referida a la veracidad de sus monarcas latinos, así como la del carácter mitológico de sus leyes. Una vez resuelto ese punto, se abordará la situación de la paelex en el periodo arcaico, figura que habrá de ser contrastada críticamente con el concubinato descrito desde el siglo II a.C., hasta las menciones incorporadas en el Digesto. Igualmente, el objeto de esta investigación será determinar si la paelex corresponde a una institución propia del derecho de familia arcaico, o bien si su existencia en la época regia representa una fisura al carácter monogámico de la familia romana.
This paper addresses the figure of the paelex in its legal and ritual context during the period of the Roman monarchy. This latter element of temporality will require us to confront historical criticism, referring to the veracity of its Latin monarchs as well as the mythological nature of its laws. Once that point is resolved, we will address the situation of the paelex in the archaic period, a figure that will have to be critically contrasted with concubinage as described from the 2nd century B.C. onwards, up to the mentions incorporated in the Digest. Likewise, the aim of this investigation will be to determine whether the paelex corresponds to an institution inherent to archaic family law, or whether its existence during the regal period represents a breach in the monogamous nature of the Roman family.
