El desmesurado avance tecnológico ha ocasionado grandes desafíos legales en diferentes rubros, entre ellos en el aspecto creativo, donde existe una continua discusión sobre quién debe ser considerado como autor y recibir el respaldo legal correspondiente en futuras obras creadas a base de la inteligencia artificial.
Este artículo tuvo como objetivo determinar las implicancias de la Inteligencia Artificial en el derecho a la propiedad intelectual. Los resultados demostraron que el uso de la inteligencia artificial ha traído efectos positivos, pero a su vez negativos en el área creativa de las personas, incentivándolos a la ociosidad ocasionando que dejen de desarrollar su lado creativo; así como que, dichas creaciones ya han causado litigios y repercusiones económicas en la sociedad, evidenciándose la importancia de su regulación.
The excessive technological advance has caused great legal challenges in different areas, among them in the creative aspect, where there is a continuous discussion about who should be considered the author and receive the corresponding legal support in future works created based on artificial intelligence.
This article aimed to determine the implications of artificial intelligence on the right to intellectual property. The results of this research demonstrated that the use of artificial intelligence has brought positive, but at the same time negative, effects on people’s creative area, encouraging them to be idle, causing them to stop developing their creative side; as well as that these creations have already caused litigation and economic repercussions in society, evidencing the importance of their regulation.
