El presente artículo tiene por objeto analizar la relación existente entre la cultura de la legalidad y el sistema interamericano de derechos humanos. Los autores argumentan que las decisiones de la Corte Interamericana de Derechos Humanos pueden influenciar de forma positiva el desarrollo de la cultura de la legalidad dentro de los Estados miembros, siempre que aquellas sentencias cumplan los presupuestos mínimos de estado de derecho. El trabajo analiza el desarrollo jurisprudencial, por parte de la Corte, en relación con el derecho de propiedad indígena para ilustrar, precisamente, cómo decisiones que no realizan suficientemente exigencias básicas de certeza jurídica y determinación terminan por limitar el impacto positivo que aquellas podrían producir para la cultura de la legalidad de cualquier Estado.
The present article aims to analyze the relationship between the culture of legality and the Inter-American System of Human Rights. The authors argue that the decisions of the Inter-American Court of Human Rights can positively influence the development of the culture of legality within the States Parties, provided that they meet certain Rule of Law requirements. The body of decisions developed by the Court, regarding indigenous property rights, is analyzed to precisely illustrate how judgments —which do not sufficiently realize basic requirements of legal certainty and determination—, finally limit the positive impact that those decisions may produce for any national culture of legality.
