Este artículo aborda el interrogante sobre cómo el constitucionalismo que se denominará moderno/colonial mantiene una estrategia de conquista y expropiación de conocimientos constitucionales del sur global. Para plantear esta idea, se recurre a la obra de cuatro grandes constitucionalistas del norte global: Grimm, Zagrebelsky, Garrorena y Fioravanti. A partir de ella se estudiará cómo se configura el canon constitucional moderno/colonial, y cómo éste recurre a la operación de silenciamiento de otras realidades constitucionales. El objetivo final del artículo es proporcionar herramientas teóricas para articular la posibilidad de provincializar el constitucionalismo.
This paper tackles the question of how constitutionalism, which will be called modern/colonial, maintains a strategy of conquest and expropriation of constitutional knowledge from the global south. To put forward this idea, it will turn to the work of four major constitutionalists from the global north: Grimm, Zagrebelsky, Garrorena and Fioravanti. It will study how they shape the modern/colonial constitutional canon, including the operation of silencing other constitutional realities. The final aim of the paper is to provide theoretical tools to articulate the possibility of provincializing constitutionalism.
