En el presente artículo se precisarán las generalidades de los mecanismos ODR, posteriormente seanalizarán los beneficios y los retos procesales que comporta su aplicación en la resolución decontroversias, y, finalmente, se propondrán algunas soluciones a efectos de superar dichos retosprocesales. En la actualidad, los mecanismos ODR han comenzado a tomar importancia dentro del tráficocomercial, a tal punto que en el año 2017 la Comisión de Naciones Unidas para el DerechoMercantil Internacional (CNUDMI) profirió las Notas Técnicas a la Solución de Controversias enLínea con ocasión del aumento de las operaciones transfronterizas realizadas en línea, y lanecesidad de establecer mecanismos para resolver las controversias que surgen en este tipo deoperaciones.Por lo anterior, el objetivo general de la presente investigación es identificar los retos jurídicos dela utilización de los mecanismos ODR en Colombia, en atención a su falta de regulación, yproponer soluciones de conformidad con la normatividad colombiana actualmente vigente.
This article will specify the generalities of ODR mechanisms, then the benefits and proceduralchallenges involved in their application in the resolution of disputes will be analyzed, and finally,some solutions will be proposed to overcome these procedural challenges.At this moment ODR mechanisms have begun to take on importance within commercial traffic, tosuch an extent that in 2017 the United Nations Commission on International Trade Law (UNCITRAL) issued the Technical Notes on Online Dispute Resolution due the increase in cross-border online transactions, and the need to establish mechanisms to resolve disputes arising in this type of operation.Therefore, the general objective of this investigation is to identify the legal challenges of the ODRmechanisms in Colombia, in view of their lack of regulation, and propose solutions in accordancewith the current Colombian regulation.
