Este artículo plantea un análisis sobre la forma en que la Unión Europea protege jurídicamente a los ciudadanos de sus Regiones Ultraperiféricas, atendiendo a sus derechos, seguridad y bienestar socioeconómico en el contexto de su política espacial estratégica. Basándose en el artículo 349 del Tratado de Funcionamiento de la Unión Europea, la UE adapta su normativa para abordar las particularidades geográficas y económicas de las RUP, como su lejanía e insularidad. Este marco permite aplicar el Derecho de la UE en estas regiones con medidas específicas y temporales, a cargo principalmente del Consejo de la UE, quien asume un papel central en la adopción de decisiones adaptadas a las necesidades de las RUP.
Asimismo, la política estratégica otorga un rol geoestratégico a las RUP, que albergan infraestructuras clave como el puerto espacial en la Guayana Francesa y centros de observación en Canarias. Estas instalaciones son una evidencia clara de la importancia de mantener una protección integral que abarque tanto la seguridad como el desarrollo de las RUP en el ámbito estratégico. Además, resulta fundamental mencionar que, el enfoque combinado de integración y adaptación jurídica permite que las RUP se inserten en el proyecto europeo, respetando sus características únicas.
This article provides an analysis of how the European Union legally protects the citizens of its Outermost Regions, addressing their rights, security and socio-economic well-being in the context of its strategic policy. Based on Article 349 of the Treaty on the Functioning of the European Union, the EU adapts its legislation to address the geographical and economic particularities of the ORs, such as their remoteness and insularity. This framework allows EU law to be applied in these regions with specific and temporary measures, mainly by the Council of the EU, which takes a central role in adopting decisions tailored to the needs of the ORs.
The strategic space policy also gives a geostrategic role to the ORs, which host key infrastructures such as the spaceport in French Guiana and observation centers in the Canary Islands. These facilities are clear evidence of the importance of maintaining comprehensive protection covering both the security and development of the ORs in the strategic field. Furthermore, it is essential to mention that the combined approach of integration and legal adaptation allows the ORs to be inserted into the European project, while respecting their unique characteristics.
