El artículo cuestiona si la cesión a terceros de los derechos económicos derivados de los derechos federativos, prohibidos por la FIFA en su Reglamento sobre el Estatuto y Transferencia de Jugadores (art. 18 ter), infringe algunas de las disposiciones del Tratado de Funcionamiento de la Unión Europea, relativas al Derecho de la competencia. Para ello, se hace uso de la metodología analítica utilizada por el Tribunal de Justicia de la Unión Europea; concretamente, en las sentencias que, recientemente, ha dictado relativas a normativa federativa del ámbito deportivo, que han supuesto un cambio sustancial de la jurisprudencia existente hasta la fecha y, además, un avance en la pacífica coexistencia entre las normativas de ámbito estatal y comunitario y las normas de ámbito federativo.
The article questions whether the transfer of economic rights derived from federative rights to a third party, prohibited by FIFA in its Regulations on the Status and Transfer of Players (art. 18 ter), infringes some of the provisions of the Treaty on the Functioning of the European Union, relating to competition law. To do so, it makes use of the analytical methodology used by the Court of Justice of the European Union; specifically, in the judgments it has recently issued relating to federative regulations in the field of sport, which have meant a substantial change in the jurisprudence existing to date and, in addition, a step forward in the peaceful coexistence between state and community regulations and regulations at the federative level.
