The article analyzes recent violations of the fundamental rights of indigenous peoples, emphasizing concrete cases of structural failures. The question is to reflect, through bibliographic research, whether such violence would configure what the Federal Supreme Court understands to be an unconstitutional state of things. The objective is to identify and debate the effectiveness of fundamental rights, in environmental and sustainability matters, in the political and sociocultural context of mining in Indigenous Lands. Transgressions demonstrate interfaces with the ECI. The constitutional claims of indigenous peoples and nations remain unresolved, feeding back historical social struggles for the right to land and territory.
O artigo analisa as recentes violações de direitos fundamentais dos povos indígenas, enfatizando casos concretos, falhas estruturais e de coordenação dos Poderes. Debate-se, por pesquisa bibliográfica, se tais violências configurariam o estado de coisas inconstitucional (ECI). Lutas indígenas são demandas históricas, ultrapassam as trincheiras jurídicas, contudo, a apropriação do Direito é um mecanismo de avanço e consolidação. Assim, o ECI enfatizaria a negação de direitos fundamentais territoriais e legitimaria juridicamente as reivindicações. Objetiva-se debater a eficácia de direitos, no contexto de mineração em Terras Indígenas. As transgressões demonstram interfaces com o ECI, reivindicações irresolutas e retroalimentação de lutas pelo direito à terra e território.
