Italy has received a new conviction issued by the European Court of Human Rights for applying inhumane and degrading treatments to a prisoner with psychiatric problems who repeatedly tried to commit suicide. The Court, in this as well as in many other judgments on the same matter, draws the attention of the States to the need for an early identification of the risk of suicide and to the preventive measures to be implemented. The issue is unfortunately dramatically current in Italy, where the number of suicides in prison and the incidence of self-harming actions are constantly increasing, given the continuous violation of the rights of all prisoners. The intervention of the ECHR certainly plays a significant role, even though it is necessary to act against the very serious structural problems of the Italian penitentiary system which, in fact, make prison sentences inhumane
L'Italia ha ricevuto una nuova condanna dalla Corte europea dei diritti umani per aver sottoposto a trattamenti inumani e degradanti un detenuto con problemi psichiatrici, che in più occasioni aveva tentato di togliersi la vita. La Corte, in questa come in molte altre sentenze sullo stesso tema, richiama l'attenzione degli Stati sulla necessità di una precoce individuazione del rischio suicidario e sugli interventi preventivi da realizzare. Il tema è purtroppo drammaticamente attuale nel nostro ordinamento, nel quale il numero di suicidi e di gesti di autolesionismo in carcere è in continuo aumento e non solo tra le persone con problemi psichiatrici, stante la continua diffusa violazione dei diritti di tutte le persone detenute. L'intervento della Corte EDU assume senz'altro un ruolo significativo, anche se occorre incidere sui gravissimi problemi strutturali del nostro sistema penitenziario che, di fatto, rendono disumana la pena eseguita in carcere.
