The aim of this paper is to correlate the conceptual pair “judgement” and “punishment'” within a syllogism of deontic nature. First, the perspective is shifted from the deontic to the ontic dimension, i.e. “judgement” (J) and “punishment” (P) are considered as real phenomena, identifying their common features. The Author then examines the deontic relationship between the two concepts from both a paradigmatic and pragmatic point of view, placing them in a dialectical perspective, and he finally questions the epistemic status that governs judgement and, ultimately, its own purpose.
Il presente scritto si propone di mettere in correlazione le due macrocategorie di “giudizio” e “pena”, inserite in un sillogismo di natura deontica. Dapprima si sposta la prospettiva dalla dimensione deontica a quella ontica, cioè considerando “giudizio” (G) e “pena” (P) come fenomeni reali e individuandone le caratteristiche comuni. Ci si sofferma poi sulla paradigmatica e sulla pragmatica della relazione deontica tra i due concetti, posti in prospettiva dialettica, interrogandosi infine sullo statuto epistemico che governa il giudizio e - in definitiva - sul suo scopo.
