This article explores the impact that Artificial Intelligence can have on the essential dialectic between subject and object of law. Based on the precautionary principle we argue that the more the machine can replace man, the more it must be reiterated instrumental value: precisely because of the greater risks that derive from the delegation of mental functions, the objective responsibility of the delegating person arises. In particular, we delve into the issue of the foreseeable non-reconstructability ex post of the itinerarium mentis of deep neural networks due to their opacity semantics.
