Se trata de destacar la concepción del nivel asistencial como instrumento para apuntalar la reforma del mercado de trabajo español, al tiempo que se acompasa a las reformas llevadas a cabo por la Ley de Empleo y la Ley sobre el ingreso mínimo vital.Se pone de manifiesto la persistencia de aspectos asistenciales, tanto por los factores que son tenidos en cuenta para el acceso y duración, como sobre los colectivos integrados en su ámbito de protección.Asimismo, se subraya la creación del complemento de apoyo al empleo, argumentando sobre su naturaleza prestacional autónoma antes que como un supuesto de incompatibilidad, así como su papel de fomento del empleo en paralelo con el compromiso de activación. Por último se hace una breve referencia a los nuevos tipos infractores y al papel de la Inspección de Trabajo y Seguridad Social en el control de la compatibilidad.
This article highlights the conception of the level of assistance as an instrument to support the reform of the Spanish labour market, while at the same time discussing the reforms brought about by the Employment Act and the Minimum Basic Income Act.The persistence of welfare aspects is highlighted, both in terms of the factors that are considered for access and duration, and in terms of the groups integrated into its scope of protection.Likewise, the creation of the employment support supplement is discussed, arguing its autonomous benefit characteristics rather than an assumption of incompatibility, as well as its role in promoting employment in parallel with the commitment to actively seek new employment. Finally, there is a brief section on the new types of offenders and the role of the Labour and Social Security Inspectorate in checking compatibility.
