El Procedimiento administrativo digital en materia de la Seguridad Social ha sido cuestionado, ante los tribunales, porque suscita dudas sobre las notificaciones de las empresas incorporadas al sistema RED y la Tesorería General de la Seguridad Social. Los temas, sobre los que se han pronunciado los tribunales del orden contencioso Administrativo, han sido: 1º) la elección entre el correo ordinario y la sede electrónica de la Seguridad Social; 2º) el aviso previo a la notificación; 3º) el dies ad quem para el cómputo de los plazos; 4º) las normas técnicas que acompañan a los documentos de la Administración (metadatos) y 5º) el derecho a conocer el algoritmo con el que se tramitan y resuelven de forma automatizada determinadas cuestiones por la Administración Pública.
The digital administrative procedure in the field of Social Security has been questioned in the courts because it raises doubts about the notifications of companies that use the RED system and the Social Security Office. The topics on which the courts of the administrative order ruled are: 1) the choice between ordinary mail and the social security electronic office; 2) the notice prior to notification; 3) the final date for the calculation of deadlines; 4) the technical rules that accompany the government body’s documents (metadata); and 5) the right to know the algorithm with which certain issues are processed and resolved automatically by the government body.
