Liberdade religiosa e inclusão: a laicidade como princípio garantidor dos direitos da comunidade LGBTQIAPN+

    this article adopts an analytical-descriptive methodology to examine the interaction between secularism and fundamental rights, focusing specifically on the rights of the LGBTQIAPN+ population. The aim is to unravel how secularism, which advocates for the separation between religion and the state, contributes to the protection and promotion of the LGBTQIAPN+ community's rights, emphasizing equality, non-discrimination, dignity, and individual rights. Analyzing the evolution of secularism from the early daysof colonization, influenced by the Catholic Church and its interaction with political power, we highlight the increasing necessity of this separation, culminating in the 1891 Constitution, which solidified this division and ensured religious freedom alongside state neutrality. Currently, the challenge continues in harmonizing religious diversity with inclusive secularism, essential for the rights of the LGBTQIAPN+ community. This study reveals the critical importance of secularism and fundamental rights inpromoting an inclusive and equitable society, underlining the role of secularism as a cornerstone of cultural, religious, and social diversity in Brazil, essential for the effective protection of LGBTQIAPN+ rights.

    este artigo adota uma metodologia analítico-descritiva para examinar a interação entre secularismo e direitos fundamentais, focando especificamente nos direitos da população LGBTQIAPN+. O objetivo é desvendar como o secularismo, que promove a separação entre religião e Estado, contribui para a proteção e a promoção dos direitos da comunidade LGBTQIAPN+, enfatizando a igualdade, a não discriminação, a dignidade e os direitos individuais. Analisando a evolução do secularismo desde os primórdios da colonização, influenciada pela Igreja Católica e sua interação com o poder político, destacamos a crescente necessidade dessa separação, culminando na Constituição de 1891, que consolidou essa divisão e assegurou a liberdade religiosa junto à neutralidade estatal. Atualmente, o desafio persiste em harmonizar a diversidade religiosa com um secularismo inclusivo, essencial para os direitos da comunidade LGBTQIAPN+. Este estudo revela a importância crítica do secularismo e dos direitos fundamentais na promoção de uma sociedade inclusiva e equitativa, sublinhando o papel do secularismo como pilar da diversidade cultural, religiosa e social no Brasil, essencial para a proteção efetiva dos direitos LGBTQIAPN+
