La Justicia transicional ha sido propuesta para resolver conflictos derivados de violaciones generalizadas de derechos humanos cuya complejidad dificulta su tratamiento en el sistema penal convencional. La desaparición de personas en México constituye una violación reiterada y lacerante de derechos fundamentales que no ha podido ser resulta por el sistema penal. Por ello se han instrumentado diversos mecanismos transicionales para abordar esta problemática. Ellos han sido insuficientes e ineficaces para alcanzar los objetivos propios de este modelo justicia.
Transitional justice has been proposed to resolve conflicts arising from widespread human rights violations whose complexity makes it difficult to deal with them in the conventional criminal justice system. The disappearance of persons in Mexico constitutes a repeated and lacerating violation of fundamental rights that has not been able to be resolved by the criminal justice system. For this reason, several transitional mechanisms have been implemented to address this problem. They have been insufficient and ineffective to achieve the objectives of this justice model.
