La ley 8/2021 modifica la figura del defensor judicial que se convierte en una medida formal de apoyo de las personas con discapacidad, de carácter temporal. Tiene carácter subsidiario, pues sólo es posible establecerla en defecto de medidas voluntarias o de inexistencia de una guarda de hecho, adecuada y suficiente. Se aplica ante situaciones específicas, como la existencia conflictos de intereses entre la persona con discapacidad y quien deba prestar apoyo.
Law 8/2021 modifies the figure of the legal guardian, which becomes a formal measure of support for persons with disabilities, of a temporary nature. It is subsidiary in nature, as it is only possible to establish it in the absence of voluntary measures or in the absence of an adequate and sufficient de facto guardian. It is applied in specific situations, such as the existence of conflicts of interest between the person with disabilities and the person who must provide support.
