El presente trabajo analiza la responsabilidad de las sociedades mercantiles públicas a la luz de lo establecido en el artículo 35 de la LRJSP y la jurisprudencia contradictoria de los tribunales. Se analizan las sentencias más recientes y se trata de establecer una interpretación del artículo que se ajuste a lo dispuesto en el artículo 106 de la Constitución Española y que proteja los derechos de los ciudadanos, garantizando la seguridad jurídica.
This paper analyzes the liability of public companies in light of the provisions of article 35 of the LRJSP and the contradictory case law of the courts. The most recent rulings are analyzed and attempts to establish an interpretation of the article in accordance of article 106 of the Spanish Constitution, protecting the rights of citizens and guaranteeing legal certainty.
