En este texto se sostiene la necesidad de subrayar el problema del mal en las reflexiones sobre el castigo jurídico y la justicia penal. Para desarrollar lo anterior, (1) se exploran las razones por las que esta discusión no tiene un lugar preponderante en la iusfilosofía contemporánea, principalmente: (a) la idea de que el mal es una reflexión exclusivamente religiosa o que solo tiene sentido como preocupación teológica, y (b) la idea de que el interés por el mal nos lleva necesariamente a derroteros antiberales. Después, (2) se da cuenta de algunos planteamientos básicos de la reflexión filosófica sobre el mal desarrollada durante el siglo XX, cuando ésta es rehabilitada tras las atrocidades de las grandes guerras. (3) Finalmente, se recupera el potencial de esta literatura en la reflexión sobre el castigo, especialmente en lo que respecta a la toma de consciencia sobre las experiencias del mal de nuestro tiempo, y la necesidad de afrontarlo y dar una respuesta.
This paper argues for the need to include the issue of evil in concerns about legal punishment and criminal justice. To develop this, (1) it explores the possible reasons why this discussion has been overlooked by contemporary philosophy, arguing that the main ones are (a) the idea that evil is an exclusively religious reflection or that it only makes sense as a theological concern, and (b) the idea that concern with evil necessarily leads us down anti-liberal paths. Then, (2) some of the basic approaches of the philosophical reflection on evil developed during the 20th century, when it was rehabilitated as a consequence of the atrocities that took place during the world wars. (3) Finally, it shows the potential of this literature in the reflection on punishment, especially in the awareness of the experiences of evil in our time and the need to confront it and provide an response.
