The end of the Cold War allowed Human rights to be put on the peace-keeping agenda. In situations of internal conflicts where it notes serious and massive violations of Human rights, the Security Council decides to protect and promote them with this in mind that the respect of these rights by the state stakeholders as well as by those external to the State will contribute to the pacification of these societies and, beyond, to the upholding of international peace and security. The promotion and protection of Human rights has thus established itself as a specific mission of peace construction operations. All of the peace construction missions, based on national security, economic development and democratic governance, materially cover, so as to make them effective, the whole spectre of internationally admitted Human rights, to wit the rights to life and integrity, civil and political rights, economic, social and cultural rights. Currently, every operation of peace construction commissioned by the Security Council thus includes a specific mission of promotion and protection of Human rights, according to custom, implemented in the field by a Human rights Division. The aim of this contribution is to enlighten what is covered by this specific mission of promotion and protection of Human rights through the study of the activities led by the Human rights Divisions within the framework of the UNMIK, the UNMISS, the UNAMID, the UNMIL, the United Nations Organization Stabilization Mission in the Democratic Republic of the Congo, the United Nations Multidimensional Integrated Stabilization Mission in Central African Republic, the United Nations Mission for Justice Support in Haiti, and the United Nations Multidimensional Integrated Stabilization Mission in Mali.
La fin de la guerre froide a permis l’entrée des droits de l’homme sur la scène du maintien de la paix. Dans des situations de conflits internes où il fait le constat de violations graves et massives des droits de l’homme, le Conseil de sécurité décide de les protéger et de les promouvoir en espérant que le respect de ces droits tant par les acteurs étatiques que par les acteurs non-étatiques contribuera à la pacification de ces sociétés et, par-delà, au maintien de la paix et de la sécurité internationales. La promotion et la protection des droits de l’homme s’est ainsi imposée comme une mission spécifique des opérations de construction de la paix. L’ensemble des missions de construction de la paix, axées sur la sécurité nationale, le développement économique et la gouvernance démocratique, couvrent matériellement, dans le but de les rendre effectifs, tout le spectre des droits de l’homme internationalement reconnus. Présentement, toutes les opérations de construction de la paix mandatées par le Conseil de sécurité comprennent ainsi une mission spécifique de promotion et de protection des droits de l’homme, selon la formule consacrée, mise en œuvre sur le terrain par une Division des droits de l’homme. Le but de cette contribution est de mettre en lumière ce que recouvre la mission spécifique de protection et de promotion des droits de l’homme à travers l’étude des activités que mènent les Divisions des droits de l’homme dans le cadre de la MINUK, de la MINUAD, de la MINUSS, de la MINUJUSTH, de la MONUSCO, de la MINUSCA de la MINUSMA et de la MINUL.
