El trabajo se inscribe en una reciente línea de investigación conducente a analizar desde una visión más global y menos compartimentada el fenómeno del fuego en su relación con el Derecho y los poderes públicos. En esta concreta aportación se examina, con base jurisprudencial fundamentalmente, la incidencia ambiental de fuegos no adjetiva-dos como forestales -materia profusa y tradicionalmente estudiada por la doctrina y de justificada preocupación para el legislador-, pero que merecen una consideración jurídica peculiar, no limitada al derecho de daños o a la arraigada posición de los tribunales civiles a la hora de objetivar responsabilidades centrándose en la causalidad entre fuego y resultado y no en la causa del fuego, cuyo conocimiento -se dice- es muchas veces imposible. Elementos y equipamientos administrativos como contenedores, vehículos públicos o vertederos aparecen, al igual que los márgenes descuidados delas carreteras y los matojos de vías y parterres, entre los objetos más frecuentemente incendiables con consecuencias que, en ocasiones, trascienden hasta el medio natural. En las líneas que siguen se ofrece como muestra un conjunto de casos de interés que invitan, como se ha dicho, a reencauzar, con algunos criterios jurídicos comunes, la aparición de toda suerte de fuegos sin ceñirse tanto en su tratamiento a su etiología o a la repercusión privada, administrativa o penal de los mismos.

Ekarpen honetan, batez ere oinarri jurisprudentzialetik aztertzen da basokoak ez diren suteen eragina -sakon aztertu izan ditu doktrinak eta justifikatutako arreta eskaini izan die legegileak-, baina arreta juridiko berezia merezi dute, ez soilik mugatua kalte-eskubidera edo tribunal zibilen jarrera tinkora erantzukizunak objektibatzeko orduan, sutearen eta ondorioaren arteko kausalitatean zentratuta, eta ez sutearen arrazoian, hori jakitea sarritan ezinezkoa izaten omen delako. Su hartu ohi duten objektuen artean daude administrazioaren elementuak eta ekipamenduak -adibidez, edukiontziak, ibilgailu publikoak edo hondakindegiak-, bai eta errepide-ertz zaindu gabeak eta bideetako eta parterreetako sastrakakere, eta horien ondorioak, batzuetan, ingurune naturalera zabaltzen dira. Ondoko lerroetanlagin moduan eskaintzen da kasu interesgarrien multzo bat, irizpide juridiko berdin batzuekin bideratu ahal izateko sute mota guztiak, hainbeste mugatu gabe haien etiologiara edo haien ondorio pribatu, administratibo edo penalera.
This work is part of a recent research trend that leads to analyzse the phenomenum of fire and its relationship with Law and public authorities from a more comprehensive and less compartmentalized vision. This particular contribution studies with basis essentially on caselaw the enviromental impact of those non forest fires -profuse issue which is traditionally studied by the scholars and of justified concern for the legislator- but that deserve a peculiar legal consideration not only restricted to tort law or to the so settled position by the civil courts when they establish the responsabilities focusing on the causality between fire and result and not on the casue of fire, whose knowledge -it is said- is often impossible.Administrative components and equipments like dumpsters, public vehicles or garbage dumps are together with the neglected shoulders of the roads and the brushes of routes and flower beds are the more often sensitive to fire objects with consequences that some-times go beyond the enviroment. The following offers as a proofa group of cases of interest which invite as it is been said to redirect, with some common legal criteria, the appearance of a whole sort of fires without not limiting their treatment to their etiology or to the private, administrative or criminal effects of them.
